Hi, I carried out some work for a company, installing electrics into the shop, workshop and demo area. On a different note I also supplied computer products for the shop on a sale or return basis and I also manufactured some fibreglass moulds him. I got on well with the owner and at one point we were looking at sharing a unit together. One day when I went to carry out some more work the owner told me he was thinking of moving out, which he did the next day taking everything with him, including all my stock. I tried contacting him and his wife sent me a text saying he was in hospital, I tried calling and texting over the next few months all to no avail. my accountant informed me that the company was being struck off due to not supplying accounts and it was companies house striking off the company. I phoned CH and they said I had to send a letter to them by a certain date, which I did and they told me the date had passed which was a different date to the one they had told me?? Mean while the owner had passed my invoice to his insolvency company who phoned me up and told me to forget it as it would cost £2500+ to get my money back and was not worth the stress and hassle. After another phone call he told me that the owner had told him that the work I had carried out was for him on a personal basis and nothing to do with the business, even though it was carried out at the place of work and was related to the kind of work he did? I was then offered some cash in my hand by the insolvency company to go away. I turned this down as it didn't even cover the cost of the stock in the shop. I have had a letter from CH telling me I can reinstate the company as it was them that struck it off.
I would like to know what my options are here, including as far as I am concerned the theft of my stock, should I report this to the police, as he is refusing to acknowledge me how can I get it back?
Also if the insolvency company knew about my claim before the company was struck off should they have dealt with my claim differently? Is there any governing bodies that I can complain to?
If it is claimed the work I carried out was on a personal basis can I take him to court personally or apply to bankrupt him?
TIA Tom

Hello Thomas

I had this response from the Credit protection Association. Tey may be able to help you.

Good luck!

David

“Dear Mr Thomas,

My name is David Baber, I am Managing Director of The Credit Protection Association Plc. Our colleague David Tyler has commented on your sad story of what happened to your stock. Obviously I think you need to speak to our Litigation Managing, Ray White, and explain the full situation to him over the phone and he may be able to advise you on what you can do, if anything. It could possibly be a civil matter and may have to involve the police. We cannot advise you at this stage without knowing more details. Ray White’s telephone number during office hours is 020 8846 0066.

With kind regards

David S. Baber
Managing Director”
