Can compensation be added to invoice after 30 days before Claim in County Court? ie. Am I owed the compensation whether I take them to court or not?

Yes you are entitled to late payment compensation and interest once the invoice is overdue. You do not need to take them to court first.

Thank you James. One other question which I forgot to ask. Can compensation be added to paid invoices as well or just the interest? Sorry to be a pain. The Company I was working for until last week always paid me min. 3 months behind and now I have found out that I was undercharging them on my day rate. My invoice templeplate for my day rate messed up somehow and I didn't notice until they paid me my April invoices short last week 03/07/2016. On 14 occasions since April I did this and they said nothing when if I overcharged them they would be on to me asap. Figures were correct, labour + VAT but total added up incorrectly.

Yes the compensation and interest remain due on late paid invoices even after an invoice was paid.

there are two separate issues here though.

You can claim compensation for the late payment on each of the invoices you sent them if they were paid late.

However if you didn't invoice them properly and undercharged them, you need to now invoice the amount you failed to invoice. You can't claim compensation for late payment on charges you didn't invoice properly it because your invoice template meant the invoices didn't add up properly.
