Hi All, and Happy New Year.

Well what seemed resolved turned out to be another delaying tactic by an astute if not dishonest player of the game. I received a call from the CEO in September stating that he would have to default on the Tomlin agreement and needed more time to explore funding avenues. I immediately applied to the County Court for Judgement without hearing. Unfortunately the Judge wanted a hearing which was scheduled for 23rd Dec 2011.

I received notification of two CCJ's raised against the defendant in Oct and Nov.

In Nov I informed the Defendant that what ever the outcome of the court hearing I would be reporting him to the Insolvency Service with a view to pursuing criminal proceedings. Government funding had been used for education purposes but squirrelled away else where.....

The night before the court hearing I received notification from a Business Recovery company stating that the defendant had approached them with a view to entering into voluntary insolvency.

Needless to say the defendant didn't turn up to the hearing and the CCJ was a formality. The judge apologised and wished me a Merry Christmas (thanks). So I await contact from the business recovery company to see what is proposed however I do not hold out much hope of seeing the remaining £11600, Yesterday I reported the defendant to the insolvency service and dearly hope that his actions warrant criminal investigation. Maybe there can still be justice served.
