Well, 13th April and no reply from the debtor to my small claims application. I have now applied for a default decree, I guess after that it will be an enforcement procedure.

The simple case study really says it all about the Late Payment Legislation...ineffective.

I look forward to the next up date hoping that James will shortly advise funds in the bank but fear that won't happen anytime soon ,if at all.

Default decree was issued. Still debtor refused to pay.

Debtor was in Republic of Ireland.

I obtained a european court order, which was free. Paid 19 euros to the county sheriff for enforcement of this court order.

I have now been paid in full, including all compensation charges,interest and court fees.

Good news James. A lot of people say the current legislation is 'ineffective' or 'it does not work'(including Mark Prisk) but they never come up with a workable solution.

Your simple case study does show that it takes more than writing a claim letter and hoping for the best. You have to be determined. It should be easier to claim what you are owed by a late/non payer. Let's see if our Government will implement the best parts of the recast legislation and speed up the collection process.

They have had since February 2011 to think about it......

Even though it was a default judgement, I've still been paid in full. The delay was 60% mine.

Using the legalisation does work.

This is just one example, I have plenty more :-))
