I am worried if I understand all the definitions: I am a small franchise and my customers are individuals. Do Their debts are commercial debts, and do I calculate owed interest using Late Payment of Commercial Debts (Interest) Act 1998 or do I use County Court Act 1984 - which allows me claim 8% and can be chosen as an option when submitting Money Claim Online.
Also - as I am Eva SK t/a XXX Cleaning Company, am I an organisation or an individual when it comes to identifying myself on Money Claim Online? There is actually no option to claim as individual when entering MCOL via Government Gateway, and the user guide is not helpfull.

Hello Eva

The Late Payment of Commercial Debts is for contracts between businesses so it cannot be used for individuals.

As a t/a company you will be classed as an organisation.
