Payment of Statuary Compensation

Hi,

I'd appreciate any experience or knowledge on our issue.

We had 3 seperate invoices with another limited company, each of which had been part paid.

All of them remained part paid past the terms of the contract we have in place.

I called them and emailed them every week and was consistant told the balance would be paid - needless to say they were not.

It left me with no choice than to apply the £40 statutory payment for each one, so I invoiced them for £120.

After receiving that invoice they managed to pay the balance of the three invoice.

I said the £120 compensation stands and is due but their argument is now they have paid the invoices in full (which they have but all later than contractually agreed).

I have no wish what so ever to continue doing business with this company, but can I pursue the £120?

Hello Faci

Yes you can continue to claim the £120.00 plus any interest (which you have not mentioned) which will still be continuing to accrue on a daily basis as the debtor has not paid all the moneys owed.
It may be worth you reading through the legislation users guide to get a beter idea of what and how you can claim.

Regards

David
