Dealing with French companies

Hi

I was wondering if anyone knew what the legal redress is with a company based in France? I'm currently dealing with a Paris agency who are now 60 days overdue on a payment as of tomorrow. That's when I'll be sending them a strongly worded email but I can't really threaten legal action if the rules don't apply to a different country.

Hi Robin,

If the contract or terms state UK law applies, then you can add the charges using UK legislation. However debtors in France generally do not pay these charges voluntarily in our experience.

With regard to taking legal action in France, it is very simple to issue proceedings as a foreign creditor. But finding a good commercial advocate that wont charge the earth for every action can be challenging.

We would generally recommend trying amicable collection via an Advocate first as the costs are far less. Only moving to legal proceedings if amicable collection fails.
