Does late payment constitute breach of contract? was created by trdg01
Can late payment of an invoice constitute a breach of contract such that other terms are then not enforcible. We have a rebate clause that applies but the supplier is saying that as we paid 7 days late the rebate clause cannot be enforced.

IMHO, breaching the contract terms regarding to the time you take to pay, is a breach of contract.
