Unpaid Invoice - What do I do next?

Hi everyone, in April I invoiced a company for my services, I specified payment within 7 working days, it now several months late. I've added £40 compensation and a few pounds in interest already but it still hasn't been paid. My question is do I keep adding the interest and compensation charge or just the interest and at what point do I give up and go through a small claims court?

They keep saying the invoice will be paid asap but they just haven't, nor have they offered an explanation as to why it is so late.

Any help would be gladly appreciated!

Hello William
Compensation is a one off claim. Interest is calculated on a daily basis so the longer your claim is unpaid, the more it will cost the debtor.
When you give up and go through the small claims is when you feel you have done all you can.
The late payment users guide has plenty of helpful information.

I hope that helps

Many thanks David, is it normal practice to keep sending updates invoices each week/month with the new charges?

I don't think there are any hard and fast rules when you should chase but if you send a claim for interest and compensation, then a follow up a week later with revised interest and they do not respond, I personally would send a third follow up with latest interest amounts and a letter before action to let them know you are no longer prepared to wait. Particularly if there is no dispute with your claim.

Has the customer said why they have not paid you? Do they have the means to pay you if it is such a long period? Might be an idea to try and talk to the purchaser to get a reason.

Regards

David

Good to know, the customer hasn't said why they haven't paid me, just that they are sorry and they will try and sort it out but that was over 2 months ago. I don't think its for financial reasons, I just think they have poor organization.
